Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Scrapy website and services (the “Service”)
operated by Scrapy (“Scrapy”, “we”, “us”, “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
We do not sell parts, do not guarantee availability, and are not a party to any transaction between you and a dismantler.
1. Service description
Scrapy enables users to submit vehicle parts requests which may be shared with dismantlers and scrap yards in our network across Ireland and Northern Ireland. Dismantlers may contact you directly with availability, pricing, delivery options, and other details.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
By using the Service, you represent that you meet this requirement.
3. User responsibilities
- You agree to provide accurate and complete information (e.g., vehicle details, part specifications, contact details).
- You are responsible for confirming part compatibility, condition, authenticity, and suitability before purchasing.
- You agree not to submit unlawful, harmful, misleading, or abusive content.
- You agree not to misuse the Service (e.g., spam, scraping, interference, reverse engineering, or security testing without permission).
4. Payments and refunds
Certain features of the Service may require payment. Unless explicitly stated otherwise at checkout, all payments are non-refundable, including where a part is not located, a dismantler does not respond, prices are not acceptable, or you change your mind.
Payments are processed by third-party payment providers (e.g., Stripe). We do not store your full payment card details.
Your use of the payment provider is subject to that provider’s terms and policies.
5. No guarantee of results
While we aim to distribute requests widely within our network, we do not guarantee that:
- any dismantler will receive your request,
- any dismantler will respond,
- any part will be available,
- any response will be accurate, complete, or timely, or
- any quoted price, delivery cost, or timeframe will be the best or final offer.
6. Third-party providers and transactions
Any purchase, delivery, return, warranty, or dispute regarding a part is strictly between you and the dismantler or seller.
Scrapy is not responsible for the quality, safety, legality, delivery, returns, refunds, warranties, or any issues with parts.
7. Prohibited uses
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- impersonate any person or entity or misrepresent your affiliation;
- send spam, unsolicited marketing, or abusive messages to dismantlers or other users;
- attempt to gain unauthorized access to the Service, systems, or data;
- copy, scrape, harvest, or extract data from the Service without written permission;
- interfere with or disrupt the Service, including by introducing malware.
8. Content and submissions
You grant Scrapy a non-exclusive, worldwide, royalty-free license to use, reproduce, and share the information you submit for the purpose of operating the Service (including distributing your request to dismantlers).
You represent you have the right to submit this information and that it does not infringe any third-party rights.
9. Privacy
Your use of the Service is also subject to our Privacy Policy. We may share your contact details and request information
with dismantlers for the purpose of responding to your request. You acknowledge that dismantlers may contact you directly.
10. Intellectual property
The Service, including its text, graphics, logos, design, and software, is owned by or licensed to Scrapy and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.
11. Availability and changes to the Service
We may modify, suspend, or discontinue the Service (in whole or in part) at any time without liability.
We do not guarantee uninterrupted or error-free operation.
12. Disclaimer of warranties
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of liability
To the maximum extent permitted by law, Scrapy will not be liable for any indirect, incidental, special, consequential,
or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to:
- your use of (or inability to use) the Service,
- any interactions or transactions with dismantlers,
- parts quality, fitment, delivery, returns, or warranties,
- unauthorized access to or alteration of your data, or
- any third-party content or services.
To the extent permitted by law, Scrapy’s total liability for any claim relating to the Service will not exceed
the amount you paid to Scrapy for the Service in the three (3) months prior to the event giving rise to the claim.
14. Indemnity
You agree to indemnify and hold harmless Scrapy, its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your submissions, your violation of these Terms, or your interactions/transactions with dismantlers.
15. Termination
We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or if required to comply with law. You may stop using the Service at any time.
16. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date will indicate when changes were made.
Continued use of the Service after changes means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of Ireland. Where permitted, you agree that disputes will be subject to the exclusive jurisdiction of the courts of Ireland.
